Cowling Parish Council - Village Hall Statement (agreed 5th October 2009)

The Parish Council’s understanding of the position regarding the village halls following a meeting with Craven District Council, and an emailing from a Craven District Council Planning Officer.



Following a meeting with CDC on 28th September 2009, the Parish Council make the following points regarding the new and old village halls:
The New Hall

1. This building is currently unfinished and owned by Skipton Properties. It is the subject of a S106 undertaking by Skipton Properties to CDC in return for planning permission on the Acre Mill site. It was due for completion in August 2009.

2. Ian Swain (enforcement officer) is to be instructed to pursue the undertaking via legal enforcement action. Skipton Properties can still apply for an extension to the deadline. Any financial information to support the extension will be scrutinised by CDC. CDC do not have to agree to the extension if the information is not substantial.

3. The parish council intend to write to CDC to request that the new hall be delivered as per the S106 undertaking, as they are the recipients. Upon completion to specification, the new hall will be handed over to the Parish Council as owners. The VHMC will not receive the new hall or be responsible for the management of it unless agreed by the Parish Council.

4. Ultimately Skipton Properties has to come back to CDC if alterations to the undertaking are proposed, and CDC say that they will check with the Parish Council to make sure that the Parish Council are happy with these alterations.

5. The VHMC has not been given negotiating powers regarding the new hall, such is strictly the province of CDC.

6. The district councillor has also not been given negotiating powers and should not be having “one to one” meetings with the developer.


The Existing Hall

7. The existing hall is managed by the VHMC.

8. To date, despite repeated requests, the Parish Council has not been shown any legally-binding agreement which states that it has to give the existing hall to Skipton Properties. If such an agreement is provided, the Parish Council will have no option but to follow the legal course given in the agreement. If none is provided, the existing hall remains the property of the village.
